The information and other material published on this Site may include inaccuracies or typographical errors. We make reasonable efforts to ensure product information is precise and that images are as accurate as possible. Changes are intermittently made to the information on the Site without notice. Nacre reserves the right to change the Site at any time, at its discretion. Nacre does not warrant that the functions contained in the Site or any product or content contained therein will be uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available is free of viruses or other harmful components. Nacre shall not be liable for the use of the Site, including, without limitation, the content and any errors contained therein.

Delivery

Nacre currently ships in UAE: Dubai, Abu Dhabi, Sharjah, Ajman, Al Ain, Ras Al Khaima, and Umm Al Quwain. Shipping will be done by a third-party courier. Delivery within UAE cities shall be on the date requested by the customer anywhere between 8 AM – 9 PM. Orders after 4pm will be delivered on the next business day. UAE Delivery fees will be a flat rate of AED 25 on all orders. Avoid any delivery delay by providing your full address along with your correct contact details.

We will start shipping to other countries soon, but this service is not available at the moment.

Use

You must be at least 18 years old to use the Service. You may not alter or modify or add to the material you have access to or remove any copyright, trade mark or other proprietary notices from such material. You may not copy, reproduce, distribute, transmit, republish, post, or use any material or portion of the Service without the prior written consent of the Service Owner. By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

We reserve the right to refuse or cancel your order, either in full or in part, at any time for certain reasons including but not limited to: order quantity, product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or delivery address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

Information Relating to Goods

We will make reasonable efforts to ensure that the information about goods is accurate and up-to-date. However we do not warrant or guarantee that there will be no errors in the images, specifications, description and/or pricing of the goods, or that goods will always be available if you wish to place an order to purchase them. You are invited to contact us using the contact information in the “Contact us” section if you need any further information about goods. Goods purchased should be stored in a dark place with temperature controlled between 18 and 21 degrees Celsius and humidity between 45% and 55%.

We reserve the right, at any time and without notice, to modify or update the information about goods displayed on the Service, including without limitation information on prices, description and availability of goods. However, changes to price, availability or description of any goods will not affect orders submitted by you which have already been accepted by us.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. Should you forget your password, please contact us and we will send you a link in order to create a new password.

Order and Delivery Procedure

Order Procedure

You can place your order directly online, you can only choose from our displayed items. You may wish to include a personal message with the goods. You may provide the content of your personal message directly on-line. We reserve the right to reject at any point in time, any message we consider might offend the recipient for defamatory, racist, offensive, abusive, indecent, obscene, menacing or in breach of confidence, copyright or any other legal rights.

Purchases

We accept payment by Visa or Mastercard debit and credit cards in AED for its products and services. All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review the respective merchant service provider’s user agreement and privacy policy before entering any transaction. Interpretation. These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorized officer of Nacre. All refunds will be made onto the original mode of payment.

Order Confirmation

Once we receive your order placed on-line, you will receive an acknowledgement email regarding placement and delivery of your order, including an order tracking number. If you don’t receive this email acknowledgement, please contact us.

The order acknowledgement email is not an acceptance of your order. Acceptance of your order will only take place once we have confirmed your credit card authorization for your order, and the products you have ordered have been dispatched (unless we have notified you that we do not accept your order). All payments for products must be made when the order is placed. We will not reserve or despatch products before payment is received. Ownership of the products will pass to you once we have received payment in full. We cannot accept cheques or cash as payments online.

Payment Security

We assure you that payment on-line is safe and secure. The information you provide is automatically encrypted and cannot be read while transmitted over the net.
Payment Methods
Online Payment: Visa and Master cards can be used for online payment. The payment will be debited from your credit card once the order is placed. You can register your credit card details for faster shopping. We will not have access to your credit cards details except for the last four digits to help you to recognize which credit card is used. You can always delete your credit card details.

Payment Confirmation

Once your payment procedure is completed, you will receive a payment confirmation email. In rejection cases, our team will get back to you for more help.

Delivery

The products ordered by you will be your responsibility from the time at which they are delivered to the delivery address, this means that you are responsible for any loss or damage which occurs after this time. A delivery signature is required for any delivery, at this point the ownership of the goods will be transferred to the buyer. If the recipient is different from the buyer (as a gift) you will accept their signature as an evidence of delivery and transfer of responsibility.

You may place an order in advance for a scheduled delivery (for example a birthday). You can schedule for a maximum period of one month.

We do not deliver goods to PO Boxes. We can only ship to one address per order. Delivery fees will be charged in addition to the total price of the order.

Refunds or Exchanges

All items on the Service are perishable, therefore, all purchases will be final and non-refundable. We are not liable for incorrect order information provided by the customer and lost or stolen packages once the order has been delivered to the recipient’s address.

Cancellations Prior or After Despatch Once order is placed, it may not be possible to prevent an order from being dispatched. The Service and all information and functionality on the Service is provided without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Neither the Service Owner nor any of its affiliates and service providers shall be liable for any direct, indirect, incidental, consequential, or punitive or other damages or losses of any kind whatsoever arising out of your access to, or use of, the Service, including but not limited to any failure of performance, error, omission, interruption, defect or computer virus, or the deletion, failure to store, misdelivery or unavailability of any information, material, products, services, applications or features, even if advised of the possibility of such damages or losses. By using the Service, you agree to release and hold harmless the Service Owner, its affiliates, officers, directors and employees from any and all claims, demands, damages, costs and expenses of any kind whatsoever relating to use of the Service or any materials downloaded from this Service.

Conditions Of Sale

Customer’s Orders

Orders: Any orders placed by you are subject to acceptance by us according to availability of the products. We will use our best efforts to provide you with accepted orders at the expected delivery date in accordance with the Service Terms and Conditions, subject, however, to delays due to Force Majeure. Deliveries will be made by courier to your indicated address, Saturday to Thursday between 8:00am and 9:00pm, excluding Friday & official holidays.

Cancellation and changes to orders: Order placed cannot be cancelled or changed.

Refunds or Exchanges: All items on the Service are perishable, therefore, all purchases will be final and non-refundable.

Payment security

We assure you that payment on-line is safe and secure. The information you provide is automatically encrypted and cannot be read while transmitted over the net.

Notwithstanding anything contained herein to the contrary, the Service Owner shall not be held liable for any consequential, contingent or incidental damages whatsoever resulting from any use of the products provided through the Service.

Severability

If any provision of these Terms and Conditions shall be held to be invalid, illegal or unenforceable, the validity, legality or enforceability of the remaining provisions shall not be affected or impaired thereby.

APPLICABLE LAW.

The Laws of the United Arab Emirates shall govern the use of the Site and the Terms of Use, without regards to conflict of laws principals. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in U.A.E.
